Outdoor Rental Terms of Use & Rental Terms and Conditions

These Terms of Use and Rental Terms and Conditions (“Terms”) govern your access to and use of Outdoor Rental’s website, booking pages, delivery/pickup services, and equipment rentals (including but not limited to pressure washers, concrete mixers, and related accessories). “Outdoor Rental,” “we,” “us,” or “our” refers to Outdoor Rental. “You” or “Renter” refers to the individual or entity renting equipment from us.

By requesting a quote, making a reservation, taking possession of equipment, or using any rented equipment, you agree to these Terms.


1) Eligibility and ID Requirement

  1. Minimum Age. You must be at least 18 years old to rent equipment from Outdoor Rental.
  2. Valid Identification Required. A valid driver’s license or government-issued photo ID is required for every reservation. We may refuse to release equipment if ID cannot be verified.
  3. Authority to Rent. If you rent on behalf of a business, you represent you have authority to bind that business to these Terms.
  4. Right to Refuse Service. We reserve the right to refuse rentals for any lawful reason, including safety concerns, suspected fraud, or prior misuse.

2) Rental Agreement Hierarchy

These Terms apply to all rentals. If you sign a separate rental agreement, or if an invoice includes additional terms:

  • The signed agreement/invoice controls only where there is a direct conflict.
  • All other sections of these Terms remain in effect.

3) Reservations, Pickup/Delivery Scheduling, and Availability

  1. Reservations. Reservations are not guaranteed until confirmed by Outdoor Rental.
  2. Availability. All equipment is rented on an availability basis. Outdoor Rental may substitute a comparable item at our discretion (or cancel and refund applicable rental charges) if equipment becomes unavailable due to damage, maintenance, or prior late return.
  3. No-Shows. If you fail to appear for pickup or are not available for delivery/pickup during the scheduled window, we may charge a trip fee and/or minimum rental charge.

4) Rental Period, Start/End Time, Extensions, and Late Returns

  1. Rental Start. The rental period begins at the earlier of:
    • the time the equipment is delivered and made available to you, or
    • the scheduled pickup/check-out time.
  2. Rental End. The rental period ends when the equipment is returned to and accepted by Outdoor Rental (or physically picked up by Outdoor Rental if pickup service is scheduled).
  3. Extensions (No Additional Extension Fee). Extensions are not subject to an additional extension charge, but are subject to availability and must be requested before the rental end time. If approved, you will be charged the normal rental rate for the additional time/days.
  4. Late Charge. If equipment is not returned by the agreed return time/date, you will be charged:
    • the daily rental rate for the equipment, plus
    • an additional $5 per day late fee, until the equipment is returned and accepted.
  5. Failure to Return. If equipment is not returned and cannot be recovered promptly, you may be responsible for replacement cost and related expenses (see Section 11).

5) Pricing, Taxes, and Payment

  1. Rates. Rental rates are shown on the listing/booking confirmation and/or invoice.
  2. Taxes. Applicable taxes may be added where required by law.
  3. Payment Authorization. By reserving or renting, you authorize Outdoor Rental to charge your payment method for all amounts owed under these Terms, including deposits, fees, and damage/repair costs.

6) Delivery and Pickup Terms

Outdoor Rental may offer delivery and/or pickup services.

  1. Delivery Fee.
    • $16.00 delivery fee for locations within 3 miles of our location, and
    • $0.50 per mile beyond 3 miles (additional).
  2. Access & Site Conditions. You must provide safe, unobstructed access to the delivery/pickup location. If we cannot safely deliver or retrieve equipment due to blocked access, unsafe conditions, stairs, poor lighting, aggressive animals, or other hazards, we may reschedule and/or charge a trip fee.
  3. Delivery/Pickup Windows. Times are estimated windows. You agree to be available and ensure the equipment is accessible during the agreed window.
  4. Placement. We will place equipment in a reasonably accessible area. You are responsible for jobsite setup and conditions (including surface protection and drainage/runoff control as applicable).
  5. Missed Pickup. If we arrive for pickup and the equipment is not accessible/ready, additional charges may apply.

7) Equipment Condition, Inspection, and Acceptance

  1. Inspection at Handoff. You must inspect the equipment and included accessories at pickup/delivery.
  2. Acceptance. Taking possession or using the equipment confirms it is in acceptable operating condition (normal wear excepted) and that all included accessories are present.
  3. Problems/Defects. If a problem is discovered, stop using the equipment and notify us immediately for instructions.

8) Renter Responsibilities and Proper Use

You agree to:

  1. Use Only as Intended. Operate equipment only for its intended purpose and in accordance with manufacturer instructions and any guidance provided by Outdoor Rental.
  2. Safety & PPE. Use appropriate personal protective equipment (PPE), which may include eye protection, gloves, hearing protection, boots, and respirators where appropriate.
  3. Competent Operators Only. Ensure only competent, sober, attentive persons operate the equipment.
  4. No Modifications. Do not alter equipment, remove guards, bypass safety features, or attempt unauthorized repairs.
  5. Utilities/Consumables. Unless stated otherwise, you provide required consumables and utilities (e.g., power source, water hose/supply, fuel, detergents, concrete mix bags).
  6. Secure Storage. You are responsible for safeguarding equipment against theft, weather exposure, and unauthorized use.

9) Prohibited Uses

You may not:

  1. Use equipment unlawfully or in violation of regulations.
  2. Use equipment in a reckless or unsafe manner, including while impaired.
  3. Subrent, loan, sell, or transfer equipment to any other party without written consent from Outdoor Rental.
  4. Remove or alter serial numbers, labels, or safety warnings.
  5. Use pressure washing or other equipment on hazardous materials/surfaces without proper controls and compliance (e.g., lead paint, asbestos-containing materials, energized electrical equipment).

10) Return Condition Requirements

  1. Same Condition Standard. Renters must return equipment in the same condition as received, ordinary wear excepted.
  2. Cleaning/Material Hardening. Equipment returned excessively dirty, with hardened material (e.g., concrete) in/on components, or otherwise not in the same condition may incur cleaning/repair charges.
  3. Missing Accessories. Missing or swapped accessories/parts will be charged.

11) Security Deposit, Damage, and Additional Recovery Rights

  1. Security Deposit. Outdoor Rental may require a security deposit or authorization hold.
  2. If Returned Not in Same Condition. If the item is not returned in the same condition as before, the renter will be charged the deposit.
  3. Additional Charges Beyond the Deposit. If the deposit is insufficient to cover cleaning, repair, parts, labor, replacement, administrative time, or other costs necessary to restore the equipment, Outdoor Rental reserves the right to recoup any additional charges beyond the deposit to properly fix the machine.
  4. Loss/Theft. You are responsible for loss or theft while the equipment is in your possession. Replacement costs may apply.
  5. Deposit Release Timing. After Outdoor Rental releases the security deposit/authorization hold, it may take 2–3 days for the funds to appear back in your account depending on your bank/payment provider.

12) Maintenance, Service Interruptions, and Substitutions

  1. Routine Maintenance. Do not attempt repairs unless authorized. Contact Outdoor Rental for issues.
  2. Breakdowns Not Caused by Misuse. If equipment malfunctions through no fault of the renter, notify us immediately. Outdoor Rental may, at our discretion, repair, replace, or adjust rental time. We are not responsible for project delays, missed deadlines, or consequential damages.
  3. Misuse/Neglect. If failure is due to misuse, improper operation, clogs, lack of cleaning, electrical misuse, or neglect, the renter is responsible for resulting costs.

13) Assumption of Risk and Liability Waiver (Outdoor Rental)

Using rental equipment involves inherent risks that can cause injury, death, and property damage. To the fullest extent permitted by law:

  1. Assumption of Risk. You voluntarily assume all risks associated with:
    • selecting, transporting, and using rented equipment,
    • jobsite conditions (including surfaces, slopes, drainage, power/water access),
    • and the manner in which the equipment is operated.
  2. Waiver. You agree to release and hold harmless Outdoor Rental from claims arising from your use or misuse of the equipment, except where prohibited by law.
  3. No Professional Advice. Outdoor Rental does not provide engineering, construction, or safety consultation. You are responsible for determining suitability and safe use.

14) Indemnification

You agree to defend, indemnify, and hold harmless Outdoor Rental, its owners, employees, and contractors from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your rental, possession, transport, or use of equipment,
  • your breach of these Terms,
  • injury to any person (including you and third parties),
  • or damage to property.

15) Limitation of Liability

To the maximum extent permitted by law:

  1. Outdoor Rental is not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits or project delays).
  2. Outdoor Rental’s total liability for any claim is limited to the amount you paid for the rental charges for the specific rental giving rise to the claim.

16) Cancellations and Refunds

  1. Cancellations. Cancellation policies may vary by item and season. Fees may apply depending on notice and scheduling impacts.
  2. Weather/Force Majeure. Outdoor Rental is not responsible for delays or inability to perform due to weather, traffic, disasters, outages, or events beyond our control. We will make reasonable efforts to reschedule.

17) Website Use Rules

By using Outdoor Rental’s website or booking tools, you agree not to:

  • attempt unauthorized access,
  • disrupt service,
  • scrape content,
  • upload malicious code,
  • or misuse forms/messages.

We may suspend or block users for abuse, fraud, or security reasons.


18) Intellectual Property

All website content, logos, photos, text, and graphics are owned by or licensed to Outdoor Rental and may not be copied, reused, or distributed without permission.


19) Privacy

Outdoor Rental may collect and use information needed to process reservations, verify identity, prevent fraud, complete payments, and provide services. If Outdoor Rental maintains a separate Privacy Policy, that policy governs data practices.


20) Governing Law and Venue

These Terms are governed by the laws of the state where Outdoor Rental operates (unless otherwise required by law). Venue for disputes will be the appropriate courts in the same jurisdiction, unless otherwise required.


21) Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.


22) Changes to These Terms

Outdoor Rental may update these Terms at any time. Updated Terms will be posted with a revised effective date. Continued use of services after changes constitutes acceptance.
